Plaintiff Patricia A. Hoggarth commenced this adversary proceeding by Complaint filed April 23, 2003, seeking a determination that obligations of Debtor-Defendant Kenneth B. Hoggarth stemming from a judgment and decree entered in the parties’ divorce is nondischargeable under 11 U.S.C. § 523(a)(5) and (15). She further seeks the imposition of a constructive trust upon the Debtor’s interest in Hoggarth Bros., a business entity owned by the Debtor and his three brothers.
