This was an action by the appellee against the appellant, to recover damages for the alleged wrongful ejection of the plaintiff from the railway carriage of the defendant.
The action was brought in Miami county, but a change of venue was taken to Pulaski.
Issue, trial by the court, finding and judgment for the-plaintiff for six hundred dollars. Motion for a new trial oa the ground of overruling a motion to suppress certain portions of a deposition, and that the finding was not sustained, by the evidence, overruled, and exception.
