BORAH, Circuit Judge.

This is an appeal in a tort action brought by plaintiff, Charles A. Iler, to recover damages for personal injuries sustained as a result of the alleged negligence of the defendant Seaboard Air Line Railroad Company in the operation of its train which struck the car plaintiff was driving while on a public crossing in the municipality of Cuth-bert, Georgia. In accordance with the Georgia practice of pleading, the complaint alleged specific acts of negligence.
