The admitted facts in this case- are that Andrew J. Berryhill was a member by mixed-blood of the Creek tribe of Indians; that he died intestate, while an infant, in the month of November, 1901, leaving surviving him his father, George Franklin Berryhill, and his mother, Clementine Berryhill; that George Franklin Berryhill was a member, by mixed-blood, of the Creek tribe of Indians, and legally enrolled; that his wife, mother of the deceased, Clementine Berryhill, was a noncitizen and not a member of any tribe of Indians; that Andrew J. Berry-hill left no brothers or sisters surviving him;…
