This is an appeal from a judgment of nonsuit in a trial before a jury. The action was one for the recovery of damages suffered by the plaintiff when she fell in an aisle-way in the market of the defendant.
Pertinent testimony on the issue of liability will be summarized. The plaintiff testified that on February 25, 1958, between 2:30 and 3 o’clock in the afternoon, she was in the food market for the purpose of shopping.
