This case originated by complaint addressed to and warrant issued from a municipal court charging the respondent with the offense of operating an automobile on a public highway while under the influence of intoxicating liquor, in violation of the provisions of Chap. 211, Sec. 74, Public Laws 1921. After hearing the respondent was adjudged guilty. The sentence imposed by the magistrate is not disclosed by the record but the respondent appealed to the Superior Court wherein he went to trial before a jury and was found *413guilty.
