This action for damages resulting from an alleged assault is before the Court on Defendant’s motion for summary judgment, Rule 56, Fed.R.Civ.P., and Plaintiff’s motion to remand this case to the Superior Court of Fulton County. 28 U.S.C. § 1447(c).

Plaintiff is a mail clerk for the United States Postal Service. Defendant is also an employee of the USPS. This action was originally filed in the Superior Court of Fulton County but was removed to this Court on Defendant’s motion pursuant to 28 U.S.C. § 1442(a)(1).
