The only question presented by this record is, whether the railway’s rights in the street, whatever they may be, are subject to assessments for benefits derived by widening State street, along which the company runs its cars. The company received a charter from the General Assembly to lay a single or double track for a street railway, to be operated and used as such, but was required to obtain permission from the' city to occupy the street for the purpose.
