This is an action of tort for the conversion of certain paper writings. It is submitted on agreed facts, and the only question presented is, whether the defendant is entitled, before issuing new certificates of stock to the plaintiffs, to retain the copies, properly attested, of the will of John A. Bird, under which the plaintiffs are trustees, and of the letter of the Probate Court of Norfolk County appointing them as such, with which it has been furnished. Whatever question might have been raised as to whether the defendant could be held liable in tort in the nature of trover for documents…
