This is an action for the recovery of rent. On the 19th day of August, 1890, Bennett & Meyers, appellees, leased to F. H. Lay certain rooms on the second floor of their three-story building on the corner of Seventeenth and Stout streets, in the city of Denver, for the term of two years. Lay occupied the rooms with his family, consisting of his wife and child, until the 19th day of July, 1891, when he abandoned them, and never returned.
