Bankruptcy Court Chief Judge Marilyn Shea-Stonum (“Bankruptcy Court”) issued an opinion (“Confirmation Opinion”) confirming Akron Thermal, Limited Partnership’s (“Debtor”) Modified Second Amended Plan of Reorganization (“Plan”) on January 26, 2009. (Case No. 07-51884, “Bankr. Dkt.,” ECF No. 567.)
