This is an action of trespass by appellee to recover damages for the depasturing by appellant’s sheep of six distinct tracts of land'separated from each other by the public domain.
In the first count of appellee’s complaint he alleged, in substance, a compliance with the requirements of section 39, Code 1915, as to marking boundaries and posting notices against trespass.
