[ Appellant, Dr. Charles F. Sale, sued appellees, American Century Casualty Company, Ashley Franklin and Michelle Barett (collectively referred to as “Appel-lees”), in a tort action for damages resulting from an automobile accident that occurred on August 9, 2008. Appellees filed a motion for summary judgment seeking a declaratory judgment that all of Dr. Sale’s personal injury claims against Appellees had been settled and compromised in full as a result of Dr. Sale’s act of negotiating and depositing a settlement check issued by ACCC in consideration of Dr. Sale’s medical bills and pain and…
