Before the court is defendant’s motion for partial summary judgment. In the motion, defendant asks the court to grant summary judgment in its favor as to the portions of plaintiffs’ complaints relating to the recovery of certain fees levied by the Nuclear Regulatory Commission (NRC). See ECF No. 37. 1 According to defendant, plaintiffs litigated this issue in the previous iteration of this case, and thus, their claims are barred by the doctrine of collateral estoppel.
