The plaintiff has a verdict against the de-, fendant in an action for deceit upon a false warranty that a lot, sold by him as an officer or agent of the Home Building Company, was free from incumbrance, and the defendant petitions for a new trial.

The evidence shows that the parties made a bargain for the lot July 3; 1896, when a portion of the purchase money was paid, and that the deed was given September 8, 1896, when the payment had been completed.
