BELCHER, Judge.

The conviction is for felony theft; the punishment, two years.

The testimony of B. J. Gross, owner of the Gross Feed Store, and Henry Joe Fletcher, Gross’ bookkeeper, shows that the appellent, owner of the Wholesale Distributing Company, which manufactures Wipe Away Cleaner, represented to them that he had been selling his cleaner in Fannin County for some time and had a large and regular volume of business with the schools m Fannin County but they could remember only the names of the Dodd City and Telephone Schools of those named.
