HOBBY, Judge.

This suit is an ordinary action of trespass to try title, brought on February 28, 1877, by Gustave Opperman, originally against *107John Berlocker. By amendment filed in February, 1885, the death of said Berlocker was alleged, and his administrator, G. A. Meyer, was made a party.

It was also alleged that Louisa Jones, John, and Charles Berlocker were the heirs at law of the deceased John Berlocker and his first wife Anna, also deceased, and that the second wife of said John Berlocker, Louisa J., and her minor children Bertha, Sextus, and Leo Robert, survived said John Berlocker, and…
