The defendant, Franklin Yancey, and E. G. Peoples, Jr., were together indicted on a charge of false pretense by falsely representing to M. B. Person, T. C. Bynum and J. M. Riddle (trading as Cumberland County Tobacco Warehouse) that the said Franklin Yancey and E. G. Peoples, Jr., together had entered into a contract to purchase leaf tobacco on the floors of various warehouses located in Cumberland County, and that E. G.
