*654In an action to recover on an instrument for the payment of money only, brought by motion for summary judgment in lieu of complaint pursuant to CPLR 3213, the defendant appeals from (1) an amended order of the Supreme Court, Kings County (Solomon, J.), entered May 13, 2010, which granted the plaintiffs motion, and (2) a judgment of the same court entered May 13, 2010, which, upon the amended order, is in favor of the plaintiff and against him in the total sum of $5,732,319.74.
Ordered that the appeal from the amended order is dismissed; and it is further,
