B. F. Gardner, a lunatic, was tlie owner of 1,256 acres of land in Magoffin county. His committee, Tone Gardner, instituted an action in tliat county against Mm and procured a sale of the land under section 489 of tlie Code, upon tlie ground "that it was necessary to obtain means for Ms support. At that sale appellee Howard became tlie purchaser, the sale was confirmed, he paid the purchase price and the land was conveyed to him.
