We dissent. Victory Temple Assembly of God, (Victory Temple) filed a mandamus proceeding to compel defendant, Recorder of Mortgages for the Parish of Jefferson, to cancel and erase from the parish records the inscription of a collateral mortgage. The holder, Ralph Miller, intervened in the proceeding. Victory Temple moved for and was granted a summary judgment which ordered the erasure and cancellation of in-tervenor’s collateral mortgage.
