AMEL STARK, Bankruptcy Judge:
The Plaintiff in this complaint charges that a $21,170.71 default judgment obtained against the Debtor in the Superior Court of New Jersey should be excepted from discharge under section 523(a)(6) of the Bankruptcy Code for the reason that the judgment was based upon a “willful and malicious” assault and battery against the Plaintiff by the Debtor.
