The trial of this case in the Circuit Court resulted in a verdict and judgment for the plaintiff to the amount of fifteen thousand dollars, and the defendant prosecutes this appeal.

The appellant was engaged in the business of operating a coal mine at Troy, in Madison county, Illinois, and the appellee had worked there for about seven or eight years and during that time had been engaged in practically every employment about the mine. For more than one month before appellee was injured he was employed as a slate shifter and timberman, and his duties were to clean up falls and remove fallen…
