Jesse Moore and bis wife were the joint owners of a small lot and house in the city of Louisville, upon which they .resided. The wife died while she and her husband were residing in the house. Thereafter, in the month of *527July, 1913, the appellee, Maggie Conway and her husband, entered into a contract with Moore, by the terms of which it was agreed that the appellee and her husband would occupy .Moore’s house, as tenants, and for the rent of the house and five dollars per month they would board Moore.
