The judgment and order should be affirmed. The indictment charged, and the jury convicted of,'a conspiracy under subdivision 4 of section 168 of the Penal Code. Such conspiracy was alleged between the two defendants to cheat and defraud people and to obtain money and other property by false pretenses.
