Polaris Amphitheater Concerts, Inc. (“Polaris”) appeals the judgment of District Judge Graham that the ordinance enacted by the City of Westerville, Ohio (“Westerville”) to control the impact of excessive noise on residential communities violates none of the rights guaranteed Polaris under the Federal or Ohio Constitution. Polaris raises in this appeal numerous constitutional challenges to the noise ordinance, but many of them have been acknowledged and thoroughly exhausted in the Memorandum Opinion of the District Court.
