The following are the facts stated in the complaint. On the 8th of July, 1866, Jacoh Bybee, then, the owner of the *263land mentioned in the complaint and lying in said county of Kosciusko, executed a mortgage thereon to Washington Bybee, one of the appellees, to secure the payment of the sum of five thousand two hundred and ninety-three dollars and thirty-six cents.
