Appeal from an order of the Supreme Court (O’Shea, J.), entered September 23, 2013 in Chemung County, which denied defendants’ motions for summary judgment dismissing the complaint.
On September 11, 2004, Charlene Hoad, who was in her 29th week of pregnancy, went to a local emergency room, but was transferred to defendant Arnot Ogden Medical Center (hereinafter AOMC) shortly after midnight once it was confirmed that she had a premature spontaneous rupture of membranes.
