Guidry v. Dutel

Proceeding by Oalice Guidry against Gas-ton Dutel for the contest of an election. The trial judge granted an order requiring plaintiff to elect whether to ask to be seated as the duly elected candidate, or to ask that the election be set aside as null and void, and plaintiff applies for mandamus, prohibition, and certiorari.

Plaintiff alleged that at an election held in the town of Abbeville on the 5th day of April, 1920, that he was elected town marshal for the term of two years, but that the defendant Dutel has been declared elected to said office. He further alleged that certain persons had voted for Dutel, who were not entitled to vote at the election, and that certain tickets had been placed in the ballot box for him which had not been counted by the commissioners.
