KRAVITCH, Circuit Judge:

James Shaw broke both legs and his back, shattered his ankles, and lost one-third of his right heel when he fell from the roof of a building. Because he could no longer work, Shaw submitted a claim to National Union Fire Insurance Company for “permanent total disability” benefits under an insurance policy issued in Florida the previous year.
