MURNAGHAN, Circuit Judge:

Julius M. Levy appeals from a judgment of conviction under 21 U.S.C. § 841(a)(1) which makes it a crime to possess cocaine with an intent to distribute, a felony. The district judge imposed a sentence of four years, with a special parole term of five years. Of the four grounds asserted for reversal, the one which we regard as dispositive is the refusal of the district judge to instruct the jury that a possible verdict would have been one of guilty of the lesser included offense of simple possession, a misdemeanor.
