McWhorter, Judge:

This is an action of ejectment brought by S. I. Robinson and others in the circuit court of Wetzel County against John M. Lowe for a tract of one hundred and thirty-six acres of land. The plea of not guilty was entered and issue joined. The defendant then upon the record “disclaimed any interest in the land in controversy in this action and described in plaintiff’s declaration, except that portion of said land which is bounded by the blue lines on plat in this action and which lies west of the red line running from a white oak at No. 14 south twenty-five, west one hundred and…
