This is before the court for disposition of defendant’s preliminary objections to plaintiff’s complaint.

Plaintiff has filed for support on behalf of her niece, Vickie Mummert, born on August 21, 1964, in York, Pa.

Defendant in his preliminary objections denies paternity. In addition, defendant avers that plaintiff’s action is barred by the Crimes Code, 18 Pa.C.S.A. §4323(b) (since repealed) and by section 6704(e) of the Judicial Code, 42 Pa.C.S.A. §6704(e), as amended by Act 1978-46.
