BURKE, Judge.
The appellant, Timothy Scott Boyle, was convicted of murdering two-year-old Savannah White, an offense defined as capital by § 13A-5-40(a)(15), Ala.Code 1975, because the victim was under the age of 14 at the time of her death, and for possessing a controlled substance, a violation of § 13A-12-212(a)(l), Ala.Code 1975. The jury unanimously recommended that Boyle be sentenced to death on the capital-murder conviction. The circuit court followed the jury’s recommendation and sentenced Boyle to death on his capital-murder conviction and to 10 years’ imprisonment on his possession…
