I concur in the foregoing opinion of Judge Perkins.

Stuart, J.

Beebe was prosecuted before the mayor of Indianapolis, for two distinct violations of the liquor law of 1855. The one was a charge for manufacturing beer, the other for selling it contrary to the provisions of that act. He was tried, convicted in both cases, and fined 50 dollars in each. Failing to pay or replevy the fines, Beebe was committed to prison. On his application to the judge of Common Pleas, a writ of habeas corpus was issued. The officer having him in charge returned, as the cause of detention, the proceedings, judgment…
