At 7:30 p. m. on February 14, 1955, Ruby Smith, the plaintiff, was riding in an automobile driven by her father, T. H. Lance, the defendant. He was taking her home, and en route stopped at the Green Spray Grocery store, located on the northeast corner of the intersection of Mission and Jackson streets in Sapulpa.
