This matter is before the court on a motion by the defendant, Administrator of the Burean of Workmen’s Compensation, for a summary judgment in his favor, seeking to dismiss the action on the ground that there is no genuine issue as to any material fact, and that the pleadings and affidavits attached show that said defendant is entitled to judgment as a matter of law.

It should be noted that the question raised by the motion for summary judgment is similar to that heretofore raised on a motion by the same defendant for an order to dismiss the notice of appeal and the petition; this latter…
