— The petitioner has appealed to this court from an adverse ruling in a habeas corpus proceeding in the Superior Court for Walla Walla County.
The background of this proceeding is that he was sentenced in King county to be hanged for first degree murder. In his direct appeal to this court from that sentence, he made the same assignments of error that are repeated in the instant habeas corpus appeal.
