This record fails to show the indictment, or a certified copy of the indictment, upon which defendant was tried and convicted.
As gathered from the record the facts of the case are briefly these: Appellant was indicted in 1874 for theft of cattle. On the nineteenth of October, 1875, he was tried and convicted; the verdict and judgment assessing his punishment at two years confinement in the penitentiary.
