This action was commenced before a justice of the peace and taken on appeal to the county court. There are no written pleadings. From the evidence, it appears that the action is to recover damages for' an alleged breach of contract. The plaintiff was afflicted with tumors, and the evidence on her behalf showed that the defendant guaranteed to remove those tumors in three months, by means of her particular mode of treatment. The plaintiff was to pay the defendant $50.00 for the first month’s treatments' and $40.00 for each of the other two months; the payments to be made monthly in advance.…
