Plaintiff sued defendant to recover a real estate broker’s commission. Upon a trial before the court without a jury, the court found the issues for the plaintiff and entered judgment for the sum of $636 and costs. From this judgment defendant appealed to this court.

There is not much dispute on the facts. On January 13, 1955 plaintiff and defendant entered into a written non-exclusive listing contract by the terms of which defendant listed his 80 acre farm with plaintiff and authorized its sale at $289 per acre or any other amount that the…
