This is a personal injury suit, brought up by way of writ of error, and for convenience we will refer to the parties as appellant and appellee..Appellee brought suit in the District Court of Wichita County against appellant City for personal injuries, alleged to have been received by him while working for said appellant on a truck that was used at the time for hauling dirt, trash and other substances that had accumulated on the streets of said City.
