These are consolidated appeals from orders of the Cumberland County Court of Common Pleas (trial court) denying deemed approval of a land development plan. For the reasons set forth below, we reverse.
On November 26, 2008, plaintiff Gau-ghen LLC (Developer) submitted a land development plan to the Borough Manager of the Borough of Mechanicsburg (Borough) seeking approval for a five-unit apartment complex under the Borough’s Subdivision and Land Development Ordinance (SALDO).
