Mr. Justice Musmanno:

Heaven knows how many children are born of unwed parents in Pennsylvania each year, and Heaven knows also that these children are innocent and, under God, the equal of children born in wedlock. Obviously, they are entitled to live and to have the liberty to pursue happiness. But the majority decision in this case will make it difficult for these storm-tossed infants to assert equality since the decision denies them access to the legal boat launched by the Legislature to keep them buoyant on the sea of adversity over which every illegitimate child must…
