Henry Perkins, while employed by the railway company in placing ties on a flat car as they were handed to him and his co-laborer by other employes standing on the ground, was injured when one or more ties rolled or fell from the top of the pile as they were being loaded. The accident happened on May 8, 1913, and he died on *89March 18, 1914.
