The principal controversy in this case, and the one on which the right of direct appeal from the trial court to this court is based, is between some of the holders of participation certificates of the Chicago Railways Company issued under an agreement dated August 1, 1907, who sue in their own behalf and also in behalf of all other holders of such certificates who may wish to join in the suit, on the one hand, and depositaries under that agreement, the Chicago Railways Company, its directors and others, on the other hand.
