Petitioner Keith Ingraham has filed his petition for declaratory *44judgment on original proceedings in this Court requesting that parts of secs. 39-71-741(1), 39-71-741(2), and 39 71-741(3), MCA, be declared unconstitutional.

On April 3, 1989, this Court ordered respondents Champion International, the Division of Workers’ Compensation, and the Attorney General for the State of Montana to file written responses to the petition.
