This case was tried before a jury, who rendered a verdict for the defendant, appellant here. Upon a statement of the case, the plaintiff moved the trial court to set aside the verdict, and for a new trial. One of the grounds of the motion was the insufficiency of the evidence to justify the'verdict. *259The motion was granted, and from this order the defendant appeals. The abstract states that the particulars as to which it was claimed the evidence was insufficient to support the verdict are definitely specified in the statement upon which the motion for the new trial was made, but they are not…
