^ The plaintiff filed for workers’ compensation benefits after sustaining injury while in the course and scope of his employment. Following treatment, the plaintiffs doctor released him to return to work. However, the plaintiffs employment was terminated on the day he returned to work. Believing that his discharge was due to his having filed a workers’ compensation claim, the plaintiff filed suit against his employer for retaliatory discharge under La.R.S. 23:1361.
