Plaintiff Eclaire Advisor Ltd. (“Eclaire”) is Trustee for the Daweoo International (America) Corporation Creditor Trust (the “Creditor Trust”), which was established on March 13, 2002, by order of the Bankruptcy Court for the Southern District of New York, for the purpose of collecting and distributing certain assets of Daweoo International (America) Corporation (“DWA”) to its creditors.
